NOTICE OF APPLICATION TO SELL IMMOVABLE PROPERTY AT PRIVATE SALE
Notice is hereby given that HAROLD JOSEPH LOPEZ, Administrator of the Estate of JOSEPH LOPEZ, has petitioned to the court for authority to sell the undivided one-half (1/2) interest of the estate of Joseph Lopez in the following described property, in accordance in accordance with the provisions of Article 3281 et seq. of the Louisiana Code of Civil Procedure and LSA - R.S. 43:203(3), for the gross sum of $62,000 in cash for the undivided one-half (1/2) interest of the estate Joseph Lopez, with the succession to pay its pro rata share of closing costs and ad valorem taxes against the hereinafter described immovable property and with the sale to contain an “As Is” clause, which immovable property in which the estate of Joseph Lopez owns an undivided one-half (1/2) interest to be sold at private sale, is described as follows:
A certain lot of ground, together with all buildings and improvements thereon and all rights, ways, privileges and servitudes thereto, situated in Section 36, Township 11 South, Range 5 East, Iberia Parish, Louisiana, measuring 225 feet on the Northerly side of Freetown Road, by a depth between parallel lines of 650 feet and being bounded, now or formerly on the North by property of Euna Fremin or assigns, on the South by Freetown Road, on the East by private road and on the West by property of Claude J Meyers or assigns.
LESS AND EXCEPT that portion of the above described property sold by Francis Meyers and Peggy Landry Meyers to Alex Meyers by Act of Cash Sale filed for record in Conveyance Book 714, Folio 910, Entry No. 79-6836, records of Iberia Parish, Louisiana, said parcel being described as measuring 104 feet, more or less, on the Northerly side of Freetown Road, by a depth between parallel lines of 225 feet, more or less and being bounded, now or formerly, on the North by the property of Francis Meyers or assigns, on the South by Freetown Road, on the East by private road and on the West by property of Francis Meyers or assigns.
Being the same property acquired by Joseph Lopez and Dorita Theresa Bonin Lopez from Francis Meyers and Peggy Landry Meyers by Cash Sale dated July 8, 1998 and recorded July 10, 1998 in Conveyance Book 1158, Folio 594, Entry No. 98-6058 of the public records of Iberia Parish, Louisiana.
Notice is further given that net proceeds of the sale of the undivided one-half (1/2) interest of this estate, in the property hereinabove described will be deposited into the succession account for distribution in accordance of law.
Any heir or creditor of the succession who opposes the proposed sale must file his or her opposition within seven (7) days from the date on which the last publication of this notice appears.
